Welcome to the Pretiola Initiative. By accessing or using our website and services, you explicitly agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions of this agreement, you are strictly prohibited from using the site.
1. Canonical and Organizational Status
The Pretiola Initiative operates exclusively as an independent, private de facto association of the faithful. We exercise the rights of lay Catholics under Canon 215 of the Code of Canon Law to found and direct associations for charitable purposes. You explicitly acknowledge that:
- Pretiola is not an official entity, agency, or dicastery of the Holy See, the Roman Curia, or any local Diocese.
- Pretiola does not assume the legal title "Catholic" under the canonical norms of Canon 300.
- All operations are private endeavors conducted independently by the founding members.
2. Non-Custodial Informational Interface
The Pretiola website serves as a read-only graphical user interface and strategic advisory portal. We display public blockchain routing information (e.g., persistent forwarding addresses) designed to facilitate charitable micro-donations directly to authorized recipient entities (e.g., the Sr. Dolores Foundation).
We are strictly non-custodial. Pretiola is not a bank, a Crypto-Asset Service Provider (CASP), an exchange, or a wallet provider. At no point do we take possession of, custody, control, route, or execute the transfer of your digital assets or fiat currency.
3. Assumption of Risk with Digital Assets
By utilizing any digital deposit address listed on this site to initiate a cryptographic transfer, you explicitly agree that:
- Irreversibility: Cryptocurrency transactions are absolute and irreversible. Once broadcast to a blockchain network, funds cannot be canceled, refunded, or recovered by Pretiola or any third party.
- User Responsibility: You bear sole responsibility for ensuring you send the correct digital asset (e.g., EURC) on the correct supporting network (e.g., Arbitrum, Base, Ethereum). Sending unsupported assets or utilizing an incorrect network will result in the permanent loss of your funds.
- Network Fees & Volatility: You are responsible for all gas fees associated with your transfers, and you accept the inherent risks of smart contract vulnerabilities, network congestion, and exchange rate volatility during fiat off-ramping.
4. Third-Party Integrations & Compliance
Our site architecture bridges Web3 capital to localized fiat accounts using independent third-party operators. Specifically, donations are routed through the Keeta Anchor network, leveraging Bridge by Stripe for fiat off-ramping, and Footprint for identity verification.
These independent entities act as the regulated CASPs. By initiating a transfer, you agree to comply with the respective Terms of Service, Anti-Money Laundering (AML) checks, and Know Your Customer (KYC) policies of these third-party operators. Pretiola assumes no liability for blocked transactions, regulatory freezing of funds, rejected KYC applications, or technical failures caused by these independent infrastructure providers.
5. Intellectual Property Rights
Unless otherwise indicated, the Site and its contents—including source code, text, graphics, user interfaces, visual designs, and logos—are the proprietary property of Pretiola and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or commercially exploit this content without our express written permission.
6. Disclaimer of Warranties
THE SITE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. PRETIOLA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL PRETIOLA, ITS FOUNDERS, ADVISORS, OR AFFILIATES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DIGITAL ASSETS, OR LOSS OF DATA ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
8. Indemnification
You agree to defend, indemnify, and hold harmless Pretiola and its members from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of the site or your violation of these Terms.
9. Modifications
We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time. Your continued use of the Site after such changes are posted signifies your acceptance of the revised Terms.
